Welcome to BunionFit. The terms "we," "us," and "our" refer to BunionFit. BunionFit operates this website and online store, including all related content, features, tools, products, and services (the "Services"), to give you a curated shopping experience. BunionFit is powered by Shopify, which enables us to provide the Services to you.

1. Access and Account

By agreeing to these Terms, you confirm that you are at least the age of majority in your state of residence, and that you consent to any minor dependents using the Services on devices you own, purchase, or manage.

To browse or purchase from our store, you may be asked to provide information such as your email address and your billing, payment, and shipping details. You confirm that all information you provide is correct, current, and complete, and that you have the right to provide it.

3. Orders

Placing an order is an offer to purchase. BunionFit may accept or decline any order at its discretion, and an order is not accepted until we confirm it. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, as we may be unable to honor cancellation requests once an order is accepted. If we decline, change, or cancel an order, we will try to notify you using the email, billing address, or phone number provided with the order.

Returns and exchanges are governed solely by our Refund Policy.

You confirm that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place your order, as shown in your order confirmation email. Unless stated otherwise, posted prices do not include taxes, shipping, handling, customs, or import charges.

All delivery times are estimates and are not guaranteed. We are not liable for shipping or delivery delays, including delays caused by carriers, customs processing, or events outside our control. Once we hand a product to the carrier, ownership and risk of loss pass to you.

The Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design and arrangement of them, are owned by BunionFit, its affiliates, or its licensors and are protected by U.S. and foreign intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. BunionFit's names, logos, product and service names, designs, and slogans are trademarks of BunionFit or its affiliates or licensors, and you may not use them without our written permission. Shopify's names, logos, and slogans are trademarks of Shopify. All other names and logos on the Services belong to their respective owners.

7. Optional Tools

We may give you access to tools offered by third parties, which we do not monitor or control. These tools are provided "as is" and "as available," without warranties of any kind and without endorsement. We have no liability arising from your use of optional third-party tools. You use them at your own risk and should review the terms of the provider before doing so.

We may also offer new features in the future. Any new features become part of the Services and are subject to these Terms.

BunionFit is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases you make in our store are made directly with BunionFit. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and BunionFit, including any injury, damage, or loss resulting from purchased products and services. You release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with BunionFit.

Personal information we collect through the Services is subject to our Privacy Policy, and certain information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

We may suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated these Terms.

14. Agents

We may terminate this agreement or your access to the Services (or any part of them) at any time in our sole discretion, without notice. You remain responsible for all amounts due up to and including the date of termination.

The following sections continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should survive.

EXCEPT AS EXPRESSLY STATED BY BUNIONFIT, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

17. Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, BUNIONFIT AND OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AS WELL AS SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, INCLUDING ANY ERRORS OR OMISSIONS IN CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

18. Indemnification

You agree to indemnify, defend, and hold harmless BunionFit, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to any third party due to or arising from (1) your breach of these Terms or the documents they reference, (2) your violation of any law or third-party right, or (3) your access to and use of the Services.

We will notify you of any claim for which you must indemnify us, although a delay in notice will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of the claim at your expense, including the choice of counsel, but we will not settle any claim that requires non-monetary obligations from you without your consent (not to be unreasonably withheld). You agree to cooperate in the defense, including by providing relevant documents.

If any provision of these Terms is found to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. This will not affect the validity of the remaining provisions.

You and BunionFit consent to venue and personal jurisdiction in those courts.
